The Ministry of Human Resources and Emiratization confirmed the eligibility of the part-time worker to obtain annual vacations, in accordance with the actual working day of the worker with the employer, in accordance with the provisions of Clause No. (2) of Article No. .29 of Federal Decree-Law No. 33) for the year 2021 regarding the regulation of labor relations, indicating that the duration of this license is determined based on the total hours worked after converting them into working days, divided by the number of working days in the year, multiplied by the legally established holidays, with a minimum of five working days per year for annual vacations.

The ministry indicated, in an indicative publication that it spread on its official pages on social media platforms, that in the calculation of these accumulated permits, the part of the day is considered a full day, according to four determinants, the first is that the ratio is equal to the ratio between the employee’s work with a part-time contract and the employee’s work with a full-time contract, and the second The actual working day is equal to a maximum of eight hours of work per day, and the third is the number of work hours of the employee with a part-time contract equal to the number of hours that were contracted, and the fourth is the arithmetic equation of the number of hours of work with a part-time contract per year divided by the number of working hours hours on the full-time contract per year multiplied by 100 equals the ratio.

Regarding the possibility of transferring annual vacations or obtaining a cash allowance for it, the ministry indicated that the worker may not transfer more than half of the annual vacations to the following year, or may agree with the employer to grant a cash alternative based on your salary at the time of your entitlement to leave.

And he said: “In case of termination of the worker’s service, he will be paid a cash allowance for the balance of his legally due annual vacation in accordance with the base salary.”
